1. Acceptance of Terms
By accessing or using PIEHOLAI (the "App"), you agree to these Terms of Use. If you do not agree, do not use the App.
2. What PIEHOLAI Does
PIEHOLAI is a personal wellness tool that helps you record food, monitor calories and macronutrients, set goals, and review your eating patterns. Some features use artificial intelligence to estimate nutrition information from photos or descriptions you provide.
3. Not Medical Advice
The App provides general wellness information, not medical advice. It is not a substitute for a doctor, registered dietitian, or other qualified professional and must not be used to diagnose, treat, or manage a medical condition. Seek professional guidance for health conditions, allergies, eating disorders, pregnancy, or other specific dietary needs.
4. Eligibility
You must be at least 16 years old, or older if required by the laws where you live, to create an account. By using the App, you confirm that you meet this requirement.
5. Accounts and Guest Access
You are responsible for providing accurate account information, protecting your login credentials, and activity under your account. Guest access may be temporary, limited, or unavailable for some features. Guest data may be lost if you clear your browser data, change devices, or do not create an account.
6. Subscriptions and Billing
The App may offer free and paid features. If you purchase a subscription or other paid feature, the price, billing period, renewal terms, cancellation method, and any trial terms will be shown before you confirm the purchase. Payments and refunds may also be subject to the terms of the payment provider or app store used for the transaction.
7. Acceptable Use
You agree not to:
- Use the App for an unlawful, fraudulent, or harmful purpose.
- Interfere with the App, its security, or another person's use of it.
- Access accounts or data without permission.
- Scrape, copy, reverse-engineer, or misuse the App or its automated systems.
- Upload content that infringes rights, contains malicious code, or violates the law.
8. Your Content
You retain ownership of food photos, descriptions, recipes, and other content you submit. You give PIEHOLAI a limited, non-exclusive permission to host, process, reproduce, and transmit that content only as reasonably needed to operate, secure, and improve the App. This permission ends when the content is deleted, except for copies lawfully retained in backups or where retention is required by law.
9. Caregiver / Linked Accounts
If the App offers sharing or account-linking features, only share information you have the right to share. You are responsible for obtaining any required consent before viewing or sharing another person's information and for reviewing the access you grant.
10. Intellectual Property
The App, including its name, branding, design, software, and original content, is owned by or licensed to PIEHOLAI and is protected by applicable intellectual-property laws. These Terms do not grant you a right to use PIEHOLAI's branding or proprietary materials outside normal use of the App.
11. Termination
You may stop using the App at any time. You may also request account deletion through the support contact made available with the App. PIEHOLAI may restrict or terminate access when reasonably necessary to protect the App or others, comply with law, or address a violation of these Terms.
12. Disclaimer of Warranties
To the extent permitted by law, the App is provided "as is" and "as available." Nutrition values, serving sizes, automated analysis, goals, streaks, and reminders may be incomplete, delayed, or inaccurate. You are responsible for checking information before relying on it, especially when health or safety may be affected.
13. Limitation of Liability
To the fullest extent permitted by law, PIEHOLAI and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including reliance on nutrition estimates. Nothing in these Terms excludes liability that cannot legally be excluded.
14. Changes to These Terms
PIEHOLAI may update these Terms as the App or applicable law changes. The updated effective date will be posted here, and additional notice will be provided when required. Continued use after an update takes effect means you accept the revised Terms.
15. Governing Law
These Terms are governed by the laws that apply to the operator of PIEHOLAI, without regard to conflict-of-law principles, except where consumer-protection law in your location requires a different result.
